In My Book, Inc. (the "Company") establishes this Data Policy (the "Policy") as follows regarding the acquisition, display, storage, analysis, usage restrictions, and other handling of data in "FactDecode" (the "Service") provided by the Company.

This Policy applies together with the Terms of Use, Privacy Policy, and other related rules established by the Company for the Service.

This English version is provided for reference purposes only. If there is any inconsistency or conflict between the Japanese version and this English version, the Japanese version shall prevail.

Article 1 (Scope of Application)

  1. This Policy applies to market data, macroeconomic data, data derived from external data sources, User-input data, analysis conditions, analysis results, scores, charts, reports, and other data obtained, displayed, stored, referenced, analyzed, or generated in the Service.
  2. In addition to this Policy, the Privacy Policy separately established by the Company applies to the handling of personal information and user information.
  3. If external data sources or External Services are used on the Service, the terms, policies, licenses, display obligations, usage restrictions, redistribution restrictions, and other conditions established by the providers of such external data sources or External Services may apply.

Article 2 (Data Handled by the Service)

The Service may handle the following data.

1. Market data  
   Prices, trading volumes, time series, indicators, symbol information, and other data concerning stocks, indices, ETFs, foreign exchange, crypto assets, commodities, interest rates, and other financial products or markets.

2. Macroeconomic data and statistical data  
   Data concerning interest rates, prices, employment, GDP, business indicators, monetary policy, economic statistics, country or regional statistics, and other economic analysis.

3. User-input data  
   Data, notes, settings, files, text, and other information that Users input, upload, store, edit, or designate for analysis on the Service.

4. Workspace-related data  
   Information concerning Users' workspaces, including projects, datasets, factors, analysis conditions, analysis settings, analysis execution history, display settings, and storage settings.

5. Analysis results and output data  
   Scores, indicators, statistics, charts, model outputs, explanatory information, reports, screen displays, and other outputs generated, displayed, or stored on the Service.

6. Usage and operational data  
   Operation history, access logs, error information, processing history, update history, system logs, functions used, execution status, and other information necessary for maintenance, operation, improvement, and prevention of unauthorized use of the Service.

Article 3 (External Data Sources)

  1. The Service may use the FRED API and other external data sources or external APIs for analysis, display, verification, data acquisition, and service provision.
  2. Rights, terms of use, redistribution restrictions, display obligations, copyrights, license conditions, storage restrictions, download restrictions, external publication restrictions, and other conditions concerning data derived from external data sources shall be subject to the conditions established by the relevant external data sources, data providers, exchanges, third-party providers, or other rights holders.
  3. The Company may change or restrict the scope of data available on the Service, display contents, update frequency, retention period, method of use, download availability, or export availability due to specification changes, suspension of provision, failures, changes in contractual conditions, restrictions by exchanges or third-party providers, changes in laws or regulations, or other reasons concerning external data sources.
  4. When using data derived from external data sources, Users shall, at their own responsibility, confirm and comply with the source, rights, terms of use, redistribution restrictions, display obligations, copyrights, license conditions, and other restrictions applicable to such data.

Article 4 (FRED API)

  1. The Service may use the FRED API to obtain, display, or analyze macroeconomic data and other data.
  2. The Company will display the following notice on the Service or the Company's website in relation to the FRED API.

    > This product uses the FRED® API but is not endorsed or certified by the Federal Reserve Bank of St. Louis.
  3. The FRED API and data provided through FRED may be subject to terms of use, copyrights, display obligations, usage restrictions, and other conditions established by the Federal Reserve Bank of St. Louis or the relevant data providers.
  4. Data series provided through FRED may include data for which third parties hold rights or data subject to copyrights or other restrictions. When using data obtained through FRED, Users shall confirm the rights holders, sources, terms of use, and restrictions of each data series at their own responsibility.
    5. The Service is not endorsed, certified, guaranteed, or recommended by the Federal Reserve Bank of St. Louis.

Article 5 (Market Data)

  1. The Service may use external data sources to obtain, display, or analyze market data and other data.
  2. Users may use market data derived from external data sources only for viewing, analysis, and verification purposes on the Service.
  3. Unless expressly permitted by the Company, Users shall not download, export, reproduce, store, sell, redistribute, externally publish, provide to third parties, incorporate into external services, provide through an API, or use outside the Service any market data derived from external data sources.
  4. The Company may restrict downloading, exporting, storage, external output, API provision, or reuse of certain data due to contracts with external data providers, license conditions, restrictions imposed by exchanges or third-party providers, or other circumstances.
  5. If Users wish to provide, publish, or commercially use Analysis Results or output content from the Service for customers, business partners, investors, members, subscribers, or other third parties, Users shall obtain the Company's prior consent in writing or by an electromagnetic method approved by the Company. The Company may require the execution or agreement of individual contracts, electronic contracts, memoranda, application forms, purchase orders, or other additional terms specifying the scope of use, display method, prohibited acts, fees, conditions of external data providers, disclaimers, and other conditions as necessary.

Article 6 (Handling of User-Input Data)

  1. Rights to data input or uploaded to the Service by Users shall remain with the Users or the legitimate rights holders.
  2. Users represent and warrant that they have the necessary rights, authority, consents, and licenses with respect to any data they input, upload, store, or designate for analysis on the Service.
  3. Users shall not input, upload, store, or use on the Service any data that violates laws or regulations, contracts, third-party rights, terms of use of data providers, or conditions of External Services.
  4. If Users input or upload personal information, sensitive personal information, trade secrets, confidential information, undisclosed material facts, insider information, or other information requiring careful handling to the Service, Users shall confirm the necessity, legality, safety, authority, and management method at their own responsibility.
  5. The Company may handle Users' input data, workspaces, settings, logs, analysis conditions, analysis results, and other information to the extent necessary for providing, maintaining, troubleshooting, preventing unauthorized use of, improving quality of, improving functions of, analyzing usage of, managing contracts for, supporting, and improving analysis functions, indicators, models, and other service quality of the Service, as well as for the Company's research and studies, business decisions, and service operations.

Article 7 (Handling of Analysis Results and Output Content)

  1. Analysis Results are reference information intended to support Users' research, verification, hypothesis organization, and decision-making.
  2. Analysis Results depend on input data, external data, models, settings, periods, calculation conditions, update status, External Service specifications, and system status.
  3. The Company does not guarantee the accuracy, completeness, recency, usefulness, suitability, reproducibility, continuity, fitness for a particular purpose, investment performance, profits, avoidance of losses, or any other results of Analysis Results.
  4. When using Analysis Results, Users shall confirm the source data, calculation conditions, model characteristics, assumptions, limitations, risks, rights to external data, and availability at their own responsibility.
  5. Unless expressly permitted by the Company, Users shall not sell, redistribute, provide, publish, reproduce, copy, transmit, incorporate into external services, or commercially use data, Analysis Results, scores, charts, reports, screen displays, or other output content obtained, displayed, or generated through the Service to or for third parties. This shall not apply to data for which the User has legitimate rights or to the User's own original considerations and opinions.
  6. If Users wish to provide, publish, or commercially use Analysis Results or output content from the Service for customers, business partners, investors, members, subscribers, or other third parties, Users shall obtain the Company's prior written consent. The Company may require the execution of an individual agreement or additional terms specifying the scope of use, display method, prohibited acts, fees, conditions of external data providers, disclaimers, and other conditions as necessary.

Article 8 (Restrictions on Downloading, Exporting, and Redistribution)

  1. The Company may restrict downloading, exporting, storage, copying, printing, API provision, or external output of data, Analysis Results, charts, reports, and other output content depending on the type of data, conditions of external data providers, contract plan, purpose of use, User authority, system restrictions, and other circumstances.
  2. Unless expressly permitted by the Company, Users shall not acquire, store, accumulate, reproduce, process, redistribute, or provide to third parties data derived from external data sources in a form usable outside the Service.
  3. Users shall not use screens, charts, data tables, Analysis Results, scores, reports, or other output content of the Service in a manner that violates this Policy, the Terms of Use, conditions of external data providers, or third-party rights, regardless of the method, including screenshots, copying, manual input, scraping, automated acquisition, or any other method.

Article 9 (Processed Data, Statistical Information, and Service Improvement)

  1. The Company may handle information generated or accumulated on the Service, including Users' usage status, input data, analysis conditions, settings, analysis execution history, analysis results, and operation history, for providing, maintaining, improving quality of, improving functions of, developing new functions of, improving analysis functions, indicators, models, and other service quality of the Service, as well as for research and studies, business decisions, and service operations.
  2. The Company may process, aggregate, statistically analyze, analyze, or otherwise handle the information set forth in the preceding paragraph in a manner that does not identify any individual or specific User, and may create statistical information, aggregated information, analytical information, insights, know-how, indicators, models, analysis methods, and other outputs, and use them for the Company's business activities.
  3. Rights to statistical information, aggregated information, analytical information, insights, know-how, indicators, models, analysis methods, and other outputs created pursuant to the preceding paragraph shall belong to the Company, except for the original data itself for which Users have legitimate rights.
  4. The Company will not publish or provide Users' individual workspaces, input data, analysis conditions, or analysis results in a form that identifies any individual or specific User as sales materials, public relations materials, materials for third parties, or functions for other Users, except where the User has consented, where required by law, or where necessary for legitimate purposes including providing, maintaining, security response, preventing unauthorized use of, or supporting the Service.

Article 10 (Data Retention, Deletion, and Backups)

  1. The Company retains data, logs, analysis results, workspace information, and other information on the Service for the period necessary for legitimate purposes including providing the Service, contract management, fee settlement, maintenance, troubleshooting, prevention of unauthorized use, ensuring security, legal compliance, dispute resolution, accounting and tax processing.
  2. Even if a User requests data deletion, account deletion, or contract termination, the Company may retain certain information for a certain period to the extent necessary for legal compliance, fee settlement, dispute resolution, prevention of unauthorized use, backups, log management, audit records, and other legitimate purposes.
  3. Information stored for backups, logs, audit records, and other system operation purposes may be sequentially deleted or anonymized in accordance with normal operational cycles.
  4. Users acknowledge in advance that all or part of data, analysis results, logs, or workspace information may become unavailable due to system failures, External Service failures, maintenance, specification changes, contract termination, legal compliance, or other reasons.

Article 11 (User Compliance Obligations)

Users shall comply with the following matters when using data on the Service.

  1. Comply with laws and regulations, the Terms of Use, this Policy, the Privacy Policy, conditions of external data providers, and third-party rights.
  2. Not sell, redistribute, externally publish, provide to third parties, incorporate into external services, or commercially use data derived from external data sources beyond the scope permitted by the Company.
  3. Not infringe copyrights, trademarks, display obligations, license conditions, or redistribution restrictions of data providers, exchanges, third-party providers, or other rights holders.
  4. Not use data or Analysis Results on the Service without authorization for investment advisory services, investment management services, financial instruments transactions, buy or sell recommendations, investment solicitation, advice to customers, redistribution to third parties, or any other purpose that requires registration, license, authorization, or contractual authority under applicable laws or regulations.
  5. Not acquire or use data on the Service by scraping, crawling, automated acquisition, reverse engineering, circumvention of access controls, or any other method not permitted by the Company.
  6. Not use data on the Service in a manner that infringes the rights, credit, or interests of external data providers or third parties.

Article 12 (Disclaimer of Warranties)

  1. The Company does not warrant the accuracy, completeness, recency, usefulness, suitability, reproducibility, continuity, availability, fitness for a particular purpose, rights clearance status, or non-infringement of third-party rights with respect to data, external data, third-party data, Analysis Results, scores, charts, reports, and other output content obtained, displayed, stored, analyzed, or generated on the Service.
  2. The Company shall not be liable for specification changes, suspension of provision, failures, data delays, errors, omissions, suspension of updates, or changes in conditions concerning external data sources, external APIs, exchanges, third-party providers, or other External Services.
  3. Data and Analysis Results on the Service are not a substitute for professional judgment concerning investment, trading, finance, accounting, tax, legal, regulatory compliance, or other matters.
  4. When using data and Analysis Results on the Service, Users shall confirm the source data, sources, calculation conditions, assumptions, limitations, risks, rights relationships, and terms of use at their own responsibility.

Article 13 (Changes to this Policy)

  1. The Company may change this Policy due to changes in external data sources, changes in conditions of external data providers, changes in service contents, amendments to laws and regulations, security responses, business needs, or other reasons.
  2. When changing this Policy, the Company will notify or announce the changed contents and effective date by posting on the Service or the Company's website, by email, or by any other method the Company considers appropriate.
  3. For material changes, the Company will endeavor, within a reasonable scope, to enable Users to confirm the details of the changes.
